打臉川普禁令美法官好狂

「這所謂的法官意見十分可笑！」美國總統川普又生氣了，他在推特寫道！這次又是誰惹他？

原來，前些日子，川普針對7個穆斯林國家發出移民禁令，華盛頓州檢察長佛格森（Bob Ferguson）因而提告，西雅圖聯邦法官羅巴特（James Robart）隨即在2月3日頒布臨時禁制令，並命令全美在佛格森訴訟案未得到解決前，暫緩執行川普移行政命令。川普的命令有什麼問題？羅巴特發布的禁令就能看出關鍵：

The work of the Judiciary, and this court, is limited to ensuring that the actions taken by the other two branches (legislative and executive branches) comport with our country’s laws, and more importantly, our Constitution. The narrow question the court is asked to consider today is whether it is appropriate to enter a TRO (temporary restraining order) against certain actions taken by the Executive in the context of this specific lawsuit.

The court concludes that the circumstances brought before it today are such that it must intervene to fulfill its constitutional role in our tripart government. Accordingly, the court concludes that entry of the above-described TRO is necessary, and the States’ motion is therefore GRANTED.

本司法部及本法院的職責，僅限於確保其他兩個部門（立法和行政部門）採取的行動符合我國法律，更重要的是，符合美國憲法。今天，本院被要求審議的狹義問題是：此訴訟是針對行政部門所採取的特定行動（禁止7國移民入境美國），要求通過臨時禁令（抵制該行動）是否適當。

本院的結論是，今天提交的情況是，（臨時禁令）必須介入，以履行憲法在三方政府中的功能。根據以上，本法院最後決定是，上述的臨時禁令通過，國家動議獲得批准。
